All order place in our online shop are done with the total agreement of the terms and conditions available on www.pechextreme.com and the acceptation is required when placing the order. By clicking on the check box you agree and accept these terms and conditions. This click is the proof of a "digital signature".

These terms and conditions are made to define the rights and obligations for the parties involved in the online sales between pechextreme.com and the consumer.

Order Confirmation

The contractual information will be confirmed on the email given by the consumer on his order, and will be sent automaticaly.

Proof of transaction

The computerazied information saved in our computer system with the best security possible as considered as proofs of communications, orders and payment done between both parties.

The storage of the order sheet, invoices are done on a liable support that can be pulled out and shown s proofs.

Information about the products

All the best efforts are made to ensure you of the best information on the products are given on pechextreme.com.
Pechextreme.com or its suppliers are not responsible of any consequences, incidents, special damages resulting by electronic transmissions or the exactness even if Pechextreme.com knew about such damages.

Validity of the offer and its price

Our prices are valid on a daily basis. 

Shipping information

The products are delivered to the address mentioned in the order by the client and only in the geographical areas that we deliver to.

All our products leave our premises in perfect conditions. If a products arrives in bad conditions, the same identitcal products would be exchanged at no costs, after receiving the damaged one back.

The reimbursement or replacement of any products done with hindsight, damaged during the delivery can not taken in charge.

As all shipment, it is possible to suffer a delay or that parcel gets lost. In such a case, we would contact the shipping company to open an inquiry. All efforts will be carried out as long as needed to find your parcel. In this case, Pechextreme.com will be reimbursed by the shipping company and will send you the identical parlce and products at its own costs.

We decline all responsabilities for the prolongation of the shipping timeframe, espicially in the case of a lose of the goods, weather conditions or strikes anywhere.

Right to withdraw

The right to withdraw only applies for physical persons.

According to the L. 120-20 articles, the consumer has a legal right of seven (7) calendar days to return, at his costs the product that doesnt satisfy him. The time limit starts running on the first day of receiving the order. All return must be mentioned to Pechextreme.com's Customer Dpt in order to obtain an RMA number. The product must be returned to the following address: Marlin Fishing (RMA), 830 Bd Emile Carbon, Domaine des Chasses 7, 06210 Mandelieu la Napoule - France.

Sensible products (such as DVD, CD) should not have been opened in order for the consumer to benefit from the right to withdraw.

Only the products sent back in the orginal box or wrapping in perfect conditions will be taken back. All products that would have been altered or that the original box or wrapping and good conditions to be sold again, if not they will not be exchanged, refunded or taken back. This right to withdraw is made without any penalty, except the shipping costs back and forth. In the case of using this right, the consumer has the choice between asking for the reimbursement for the product or exchange it. In the case of an exchange, the shipping costs are to be carried by the consumer.

In case of using the right to withdraw, Pechextreme.com will do its best to reimburse the consumer in a thirty (30) days period.

Right of use

Using the brands shown and promoted on the site is strictly forbidden. Any picture, movie, or any other things in the shop in the property of our company and can not be used totally or partially. The company will act accordingly. 

Act of God

None of the parties will have failed to their obligations, as far as the execution will be delayed, hampered or prevented by an act of God. Is considered as an act of God any circonstances, resistless, outside of the parties, un predictable, inevitable, and independant from the will of both parties, and that they can not forsake it by any means possible.

The party that will be concerned by such circumpstances will let the other party know about it within a ten (10) days period after knowing such situation is occuring or will occur.

Both parties will get together, within a three (3) months period, except for an act of God, to analyse how to execute the contact between them. If the act of God has a longer period than a month, these terms and conditions could be canceled by the party affected.

By act of God we understand the ones recognized by the french legal prededents or the usual ones, but not only: blocage of the transportation system,  earthquake, fire, tempest, floodings, lightning, communication breakdown or any damages that could occur.

Partial non validation

If one or more conditions herein mentioned are invalidated or declared as such after a court decision, the other conditions are still valid and will be applied.

Applicable law

These terms and conditions are subdued to the french law. It is so fo all rules mentioned herein.

In case of a dispute or reclamation, the consumer shall, in priority, contact Pechextreme.com in order to find a friendly solution to the pending case.

Protection of your personal information

All the data and information that will entrust us are for fulfilling your order.
According to the law n° 78-17 of January 6th 1978 regarding the computers files, you have the right towards Pechextreme.com to modify, consulte, update or delete the file that you have you entrusted us with. This right can used directly online.

Dispute

Any order placed through Pechextreme.com's site carries the acceptance, without any restriction, of these terms and conditions by the consumer.

In case of a sale to a moral person, any dispute regarding the sale, (price, terms and conditions, products...) will be submitted to the french law and in front of the commercial court in Cannes (France).
